Dispensation from Sacred Orders and Return to the Lay State

Sacred Congregation for the Doctrine of the Faith
No. 962/70

Most Holy Father,

André Gingras, a professed priest of the Society of Jesus, humbly prostrated at the feet of Your Holiness, implores a dispensation from all obligations arising from Holy Orders, including the obligation of observing sacred celibacy.

Wednesday, 16 December 1970

The Most Holy Lord Paul VI, by Divine Providence Pope, having considered the report from the Sacred Congregation for the Doctrine of the Faith, has deigned to decree:

Mr. André Gingras
is to be returned to the lay state, with dispensation from all obligations arising from Sacred Orders (and from religious profession), including the obligation of observing priestly celibacy.

The Ordinary of Montreal shall ensure that everything is carried out in such a way as to avoid scandal or wonder among the faithful, and shall warn the petitioner to absent himself from places where his former clerical status is known.

He shall declare the petitioner absolved of all censures, advise him to lead an exemplary life in gratitude for this grace, perform some work of piety or charity, and—if applicable—the same applies to any accomplice.

Regarding the canonical marriage

  • the celebration shall be without pomp or display;
  • it shall take place before an approved, discreet priest;
  • without witnesses, or if necessary, with two witnesses belonging to the diocesan Curia;
  • the act shall be preserved in the secret archives of the Curia;
  • in the parish registers it shall be noted that the Ordinary of the place must be consulted if documents are ever requested.

All who take part in the execution are bound by a grave obligation of secrecy.

Finally, the Ordinary, at an appropriate time, shall send a brief report to the Sacred Congregation on the completed execution, and if any astonishment of the faithful should arise, he shall address it with prudent explanation.

All things to the contrary notwithstanding.
